These Terms of Use govern your use of sterlingpensiongroup.com, operated by Sterling Pension Group LLC, 15 N Main St #100, West Hartford, CT 06107. By using the site you agree to these terms. If you do not agree, do not use the site. A later consulting or administration agreement controls that engagement if it conflicts with these terms.

The site is informational

Pages, briefings, calculators, illustrations, and examples are general education about defined benefit and cash balance plans. They are not tax, legal, investment, actuarial, or accounting advice, and they are not a proposal for your company. Figures described as illustrative are not quotes and not IRS limits. Only a written engagement, a census, and work by the appropriate professionals can produce a number you should rely on.

No client relationship from browsing

Sending a form, using the calculator, or emailing us does not make you a client and does not create a fiduciary, attorney-client, or actuarial relationship. We may decline an inquiry. A client relationship starts only when both sides sign an engagement or service agreement.

Who we are not

Sterling Pension Group LLC is a third-party administrator and pension consultant. We are not an actuarial firm, a law firm, a CPA firm, a registered investment adviser, or a broker-dealer. Where a filing requires an Enrolled Actuary’s certification, that certification is provided by an independent actuary, not by this website.

Acceptable use

You may use the site for your own business research. You may not scrape it in a way that degrades service, attempt to break or probe it, post unlawful content through a form, misrepresent your identity, or reuse our copy and layout to pass off another service as Sterling. We may block access that violates these terms.

Intellectual property

The site’s text, design, logo, and graphics are owned by Sterling Pension Group LLC or used with permission. You may share a link or quote a short passage with attribution. You may not copy the site, the briefing archive, or the logo for a competing service without written consent. IRS and Department of Labor pages we link to remain the property of those agencies.

Calculators and third-party links

Any calculator on this site is a sketch. It can be wrong for your facts, and it may not reflect a law change until we update it. Links to the IRS, the Department of Labor, the PBGC, or other sites are for convenience. Those sites have their own terms, and we are not responsible for them.

Disclaimer of warranties

The site is provided “as is” and “as available.” We disclaim warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We do not warrant that the site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, Sterling Pension Group LLC and its members, employees, and contractors are not liable for any indirect, incidental, special, consequential, or lost-profit damages arising from your use of the site, or from a decision you make before an engagement is in place. Our total liability for a claim arising only from use of the public website will not exceed one hundred U.S. dollars. Some states do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

If you misuse the site or submit information you had no right to send, you will indemnify Sterling against claims, losses, and reasonable legal costs that result, except to the extent caused by our own misconduct.

Governing law

These terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Courts located in Connecticut are the exclusive venue for a dispute about the public website, except that we may seek injunctive relief anywhere to protect our intellectual property.

Changes
